- Scope
- These Terms of Service apply to all purchases made through the LUMOS online store (lumos.art), operated by Gregory Muller, Erdberger Lande 36, 1030 Vienna, Austria ("we", "us", "LUMOS").
2. Products
LUMOS offers museum-grade fine art photography prints, framed and produced to order, released in limited editions of 25 pieces per work.
3. Order and Contract Formation
By placing an order through our website, you make a binding offer to purchase the selected artwork. A contract is formed once we confirm your order by email.
4. Prices and Payment
All prices are listed in Euro (EUR) and, for deliveries within the EU and Switzerland, include shipping. Payment is processed securely via Shopify Payments (Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay).
5. Production and Delivery
Each artwork is produced individually after your order is placed. Please allow 9-14 business days for production and delivery within Europe; additional time may be required for international deliveries. See our Shipping Policy for details.
6. Right of Withdrawal
As each artwork is made to your order as a personalized item, the statutory right of withdrawal does not apply once production has begun, in accordance with Art. 16(c) of EU Directive 2011/83/EU. See our Return & Refund Policy for details.
7. Warranty
Your statutory warranty rights remain unaffected by the exclusion above.
8. Copyright
All artworks remain the intellectual property of the artist, Gregory Muller. Purchase of an artwork transfers ownership of the physical piece only; it does not transfer any copyright, reproduction, or commercial usage rights.
9. Limitation of Liability
We are liable for damages only in cases of intent or gross negligence, except where mandatory statutory liability applies, for example for injury to life, body, or health.
10. Governing Law and Jurisdiction
These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer protection provisions of their country of residence remain unaffected.
11. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
